Stone fabrication is one of the most regulated trades in California right now. The STOP Act took effect January 1, 2026. This guide covers what the law requires, how to protect yourself, what symptoms to watch for, and your rights as a worker — in English and Spanish.
Silicosis is a serious, irreversible lung disease caused by breathing in fine particles of crystalline silica — a mineral found in stone, sand, and certain manufactured surfaces. When stone is cut, ground, drilled, or polished, silica dust becomes airborne. If inhaled, these particles embed deep in lung tissue and cannot be removed.
There is no cure for silicosis. Once the disease develops, it cannot be reversed — even if all silica exposure stops. The disease can continue to progress for years after a worker leaves the industry. This is why prevention is the only effective strategy.
Stone fabricators and installers face particularly high exposure risk because cutting and grinding generates large amounts of very fine silica dust in a short period of time. California has documented cases of workers developing accelerated silicosis — an aggressive, rapidly progressing form — after just five to ten years of work without proper protection.
Silicosis cannot be treated or reversed once it develops. Symptoms often appear years after exposure — by which point the disease may already be significantly advanced. Do not wait for symptoms before taking protective measures.

Any worker who cuts, grinds, drills, polishes, or handles the cleanup of stone dust is at risk of silica exposure. This includes:
Silica is present in all stone products at varying levels. Natural stone products generally contain lower concentrations than some manufactured surfaces, though any stone cutting that generates airborne dust requires appropriate protective measures. California law applies to all stone work — natural and manufactured.
California's STOP Act and Cal/OSHA regulations apply to the fabrication and installation of all stone products containing more than 0.1% crystalline silica — which includes all commonly used stone countertop materials. The required protections described in this guide apply regardless of the specific stone type being worked on.
California's Silicosis Training, Outreach and Prevention (STOP) Act — signed by Governor Newsom on October 13, 2025 and effective January 1, 2026 — is the strictest state-level silica protection law in the United States. It is a direct response to what public health officials have confirmed is an epidemic among California's stone fabrication workers.
Understanding what the law requires is not optional for any shop owner, fabricator, or installer operating in California. Cal/OSHA can issue an immediate stop-work order if violations are observed — shutting down your entire operation on the spot.
Serious infractions: fines up to $25,000. Repeat or willful violations: up to $162,000. Dry-cutting observed in progress: immediate stop-work order — all fabrication halted on the spot. Silicosis cases must be reported within 5 days or additional penalties apply.
These five protections are legally required under Cal/OSHA Section 5204 and the STOP Act for all high-exposure tasks — cutting, grinding, drilling, polishing, and dust cleanup. Failure to implement any of these is a citable violation.
The most common compliance failure in California stone fabrication shops is using the wrong respirator. Many workers continue to use dust masks or N95 respirators — neither of which provides adequate protection for stone fabrication work under California law.
Standard dust masks and N95 respirators do not provide adequate protection against the fine silica particles generated during stone fabrication. Under California law, these do not meet the minimum requirement for high-exposure trigger tasks. Wearing one does not mean you are protected — and it does not mean your employer is in compliance.

A tight-fitting, full-face Powered Air-Purifying Respirator (PAPR) with HEPA, N100, R100, or P100 filters is the minimum legal requirement for all high-exposure tasks in California. Must be properly fitted and tested annually by a qualified person. Employers are required to provide this equipment at no cost to workers.

Under California law, employers are required to provide all required PPE — including PAPR respirators — at no cost to workers. Silicosis symptoms often appear years after the initial exposure — by which time the disease may already be significantly advanced. Early recognition of warning signs is critical. Any stone worker experiencing these symptoms should seek medical evaluation immediately and inform the doctor of their occupational exposure to stone dust.

Difficulty breathing during routine activity or at rest. May worsen progressively over months or years. One of the earliest and most important warning signs.
A cough that does not resolve with standard treatment and persists for more than a few weeks, especially if accompanied by shortness of breath or fatigue.
Unusual tiredness or weakness that limits ability to complete normal daily tasks — particularly if accompanied by breathing difficulty.
Any chest discomfort, tightness, or pain in a stone worker should be evaluated promptly, especially when occurring during physical activity.
If you seek medical care for any of these symptoms, always tell your doctor that you work with stone and that you have been exposed to stone dust. Silicosis is often misdiagnosed or missed when doctors are not aware of a patient's occupational history. California law protects all stone fabrication workers — regardless of immigration status. These rights exist whether you are documented or undocumented, employed full-time or part-time, working in a large shop or for a small contractor.

Your employer is legally required to provide: proper respiratory equipment (PAPR) at no cost to you, wet cutting methods, regulated work areas, medical exams, and a written safety plan. You cannot be asked to waive these rights or pay for required equipment.
